The Department of Health introduced deadlines for people who believed they were eligible for NHS continuing healthcare (CHC) funding but did not receive an assessment during the period of care between 1st April 2004 and 31st March 2012.
The deadlines for registering for a review of unassessed periods of care during this time period have now passed.

Appealing a decision
If you or a relative has been found not eligible for NHS Continuing Healthcare (CHC) funding, following completion of a Decision Support Tool for a previously unassessed period of care, you can appeal this decision. Information on the appeals process will be detailed in the outcome letter.

If you or a relative has been found not eligible for NHS Continuing Healthcare (CHC) funding, following completion of a Decision Support Tool for a previously unassessed period of care, you can appeal this decision.
Applications for review
We have received a high volume of requests and are currently reviewing all applications. We appreciate your patience whilst this process is ongoing.
Each case is individual and the following factors influence the time it will take us to review the application:
- the individual’s specific needs
- the length of the unassessed period to be reviewed
- the availability of records from external organisations, such as hospital notes, district nursing notes, GP notes, mental health notes, nursing and residential home records
- whether it is found that a previous assessment was completed
- whether the case passes to the full assessment stage

NHS England has published refreshed NHS Continuing Healthcare (NHS CHC) Redress Guidance for CCGs, to be used when considering NHS CHC redress payments for individuals.
The purpose of this guidance is to assist Clinical Commissioning Groups (CCGs) when settling claims arising from NHS Continuing Healthcare eligibility decisions or where an eligibility decision has been reached on a previously un-assessed period of care in respect of NHS Continuing Healthcare. The document has been updated to reflect the ‘Principles for Remedy’ from the Parliamentary and Health Service Ombudsman (PHSO) for all public bodies. The guidance retains the principle of returning the individual to the financial position they would have been in had they been assessed as eligible and the need for redress identified.

NHS Continuing Healthcare Information and NHS England Advice service pilot
NHS England has provided an NHS Continuing Healthcare Information and Advice service pilot with Beacon for the South region.
Under the pilot, information and advice is accessible in the form of free and comprehensive written guidance, and individuals are also able to access up to 90 minutes of free advice with a trained NHS Continuing Healthcare adviser.
